General terms and conditions

 1. Scope

USOVO, Owner Peter Urban acts in the field of CNC-Technology for home-/hobby- users. The General Terms and Conditions (GTC) presented on this page define the business relationship between you (customer/buyer) and USOVO, Owner Peter Urban in the version valid at the time of your order. Other conditions are only valid if they have been accepted by us in writing.

Please read these terms carefully before you place an order. By placing an order at USOVO, Owner Peter Urban you agree that your order will be subject to these conditions.

2. Contractual Agreements

USOVO, Owner Peter Urban concludes contracts with customers who are unlimited contractually capable natural persons over the age 18 years as well as with legal persons.

The articles in our web shop constitute an offer without obligation. By entering your personal data and clicking on the button „Confirm order (with costs)“ you place a binding order of the articles in your shopping cart. We will send you an e-mail confirming our receipt of your order. The e-mail will contain the details of the order and provide you with the obligatory information, which you are entitled to receive under the law. With this e-mail we accept your order. The purchase contract between USOVO, Owner Peter Urban and you is hereby concluded. During the course of the ordering process, you will receive further e-mails informing you about the status of your order.

Furthermore we also accept orders via e-mail or letter (in exceptional cases also via tele-phone). These orders only constitute an offer to conclude a purchase contract. The contract is concluded when we send you a confirmation in writing which affirms the reception and the acceptance of your order (order acceptance confirmation).

The contractor is USOVO, Owner Peter Urban.

3. Storage of your order data

Your order and its details (e.g. quantity of the ordered articles, article description, prices etc.) are stored in our data base. As a registered customer you can always take a look onto your orders after you have signed on in our web-shop.

4. Prices

The currency of all prices is EURO, gross (inclusive of 19% German VAT) and plus additional shipping fee. The shipping fee you find on our homepage under: "Shipping Costs”. Export shipments outside of the EU can cause additional customs duty, taxes and charges we have no influence on. These costs have to be paid by the buyer.

We reserve the right to adjust prices if technical adjustments are made to the product at your request between the time of the offer and the time of contract fulfilment.

Offers are not binding, especially in brochures that do not record any expiration dates.

5. Payment terms and retention of title

The invoice amount is payable in advance using the payment methods listed in the online shop.

We accept the following types of payment:

  • Payment in advance via bank-transfer
  • Payment in advance via PayPal

All products remain the property of USOVO, Owner Peter Urban until payment has been completed in full.

In the framework of our range of products, we only offer you items capable of shipment by parcel.

Unless otherwise agreed, delivery shall be made to the address specified by the purchaser in our online-shop. There is the following exception: When paying with PayPal, shipments will only be made to the address that you have saved under PayPal "Transaction Details".

On the website you can find information about the availability and the current delivery time of our products (in the particular description of the articles). We would like to draw your attention to that fact that all information concerning availability, shipment or delivery of a product are only estimated times and approximate values. They do not constitute binding deadlines nor guaranteed shipping or delivery dates. If we note while processing your order that you ordered products are not available, you will be notified separately by e-mail. The statutory rights of the buyer are not affected.

We always send all items, which you order in the framework of an ordering process, together in one parcel. Should one or several of the items ordered by you have a longer period of delivery than the other items, the entire order will be subject to the longer period of delivery. Should you subsequently order further items in addition to an order, which has not yet been shipped, a new ordering process will be opened and, as a consequence, a new purchase contract be concluded for this supplementary order. The supplementary order will be shipped in a separate parcel, for which new shipping costs will be charged.

We ship your order generally by DHL as an insured parcel (standard transport). Uninsured modes of shipment we only choose on explicit wish of the buyer.

If you order products for delivery outside of the EU, they may be subject to customs and taxes. Any additional charges for customs clearance must be paid by you.

7. Selling restriction

Generally we sell our products worldwide except to customers who are resident in the USA and Canada. We also do not deliver to states which are subject of trade restrictions.

8. Intended use of our products

*We point out, that our products are constructed for domestic and hobby-use only, but not for commercial or industrial use*!

9. Guarantee and warranty

Despite extensive testing, it cannot be excluded that our products may occasionally present defects. Damage can also occur in transit, so please check the packaging when accepting a delivery. In the eventually case of defects we reserve our right of rectification.

9.a. Guarantee:

In addition to the statutory warranty, we give you a manufacturer’s guarantee for our own products. Should a case of guarantee occur with respect to a product from a third-party-manufacturer the guarantee conditions of the particular company apply.

For our products we provide a 6-month-guarantee after delivery. If our products are re-sold during this period, the claim under guarantee devolves to the new owner. Should a case of guarantee occur with respect to one of our products, please contact us at:

Our Guarantee Conditions:

1. During the period of guarantee of 6 months from the date of sale onwards, any items being defective because of material and/or manufacturing faults will be either replaced or repaired. We will be entitled to choose between replacement and repair.

2. Should we exchange an item in whole or in part, the exchanged old components will pass into our property.

3. Any repair or exchange covered (in whole or in part) by the guarantee will neither cause an extension of the guarantee period nor trigger the commencement of a new guarantee.

4. We request you to notify us of any defect without delay as soon as you have noticed the corresponding defect.

5. The claim under guarantee has to be proofed with the original invoice.

6. Please pack the defective item properly, so that it cannot be damaged during shipment, and send it to our address mentioned above. Please also enclose the original sales receipt to the parcel.

7. If the defect is covered within the framework of our guarantee promise, we will either repair or exchange your item free of charge. In this event, the return shipment costs will likewise be borne by us.

8. Should it turn out, after an examination performed by us, that the defect is not covered by the manufacturer’s guarantee, we will contact you and discuss the further course of action with you. In this event, you will have to bear the return shipment costs.

The guarantee claim does not extend to:

  • Wear and tear components (such as gaskets, ball bearings)
  • Fragile components (such as acrylic glass lids of  tool magazines)
  • Consumable materials (such as moulding cutters)
  • Minor deviations from the target quality, which have no influence on the product’s actual utilisation value (such as optical deviations)
  • Damage caused by the insertion of dirt/filth (such as moulding cutter dust)
  • Operating errors, failure to observe the directions for use
  • Damage caused by outside factors (such as chemicals, heat, dampness, dust, excess voltage)
  • Damage attributable to normal wear and tear
  • Damage having arisen as a result of wilful/deliberate damaging
  • Defects relating to the product, which have been caused by transport or assembly
  • Consequential damage, which has occurred because of a product defect
  • Improperly installed products or improper initial operation of products
  • Damage caused by insufficient or incorrect/deficient maintenance
  • Damage caused through improper usage of our products (such as damage to a spindle/shaft running in continuous commercial operation  although it is only suitable for hobby operation)
  • Damage, in respect of which unauthorised repair attempts have already been made
  • Damage caused by force majeure or natural disasters

9.b. Warranty

In contractual agreements with non-merchants (end customers, B2C) we provide a defect-free warranty for two years after delivery. In contractual agreements with merchants (between companies, B2B) we provide a one-year defect-free warranty.

During the first six months after delivery, USOVO, Owner Peter Urban will be under an obligation, in the event of material defects, to provide evidence that the object was free of defects at the time of its delivery. After expiry of the six months, the purchaser will have to provide evidence that the purchased object was already defective at the point in time when it was handed over.

The warranty is valid for the first buyer only.

If our products are resold during this period, the new owner may have a warranty claim against the reseller, but not against USOVO, Owner Peter Urban.

10. Liability and defects

Customers must submit a written communication of any defects within 10 days of receiving the purchase at their destination of choice. This applies to non-retail customers only for obvious defects. Any such complaints will only be taken into account if the goods are still in the same state they were in at delivery.

We will accept the return of merchandise that we acknowledge to be defective, and we will offer a non-defective replacement. Instead, we can offer compensation for the reduction in value of a defective product. If a repair or a replacement delivery fails, non-retail customers have the right to request a reduction of purchase price or the cancellation of the purchase contract.

Further claims of consequential damages on the part of the buyer are excluded unless they are based on a defect covered by the warranty. The buyer must allow reasonable time and opportunity for the supplier for the correction of faults. If he refuses, then the supplier is exempt from responsibility due to defects.

A return of defective goods is only to be performed with our consent and in the original packaging or equivalent packaging. Freight costs are to be covered by the buyer. A refund will only take place in case of a justified complaint. Our liability, regardless of the legal reason, is limited to intent and gross negligence.

Any technical advice given will be to the best of our knowledge. All specifications and information available concerning suitability and application of our products are non-binding and do not exempt the buyer from performing their own tests and trials.

The buyer is himself responsible for compliance with all laws and regulations regarding the use of the goods. For suitability of the product for specific purposes, we are only liable if it is expressly guaranteed in writing.

The warranty and liability assured by USOVO, Owner Peter Urban are limited to damages that demonstrably occurred as a result of defective material, faulty design or poor execution.

Damage due to natural wear and tear, insufficient maintenance, failure to observe assembly instructions or operating instructions, excessive, unsuitable or incorrect usage, as well as other reasons that USOVO, Owner Peter Urban does not provide for are explicitly excluded.

In no case can the buyer claim compensation for damage not caused to the delivered goods themselves, like for example loss of production, loss of use, loss of orders, lost profit and other direct or indirect damage.

The limitations of liability above do not apply in the case of damage to life, body or health, for defects covered by a guarantee regarding the product's state, or defects concealed with malicious intent.

Liability under product liability law remains unaffected.

Where the liability of USOVO, Owner Peter Urban is excluded or limited, the same is also true of the personal liability of employees, representatives and agents.

11. Changes to the terms and conditions

We reserve the right to make changes to our website, rules and regulations, including these terms and conditions at any time. Your order is subject to all sales conditions, contractual conditions and general terms and conditions that are in effect at the time you place your order, unless changes to these conditions are required by regulations or legal reasons. If any rule in these terms and conditions is invalid, void or unenforceable for any reason, this rule will deemed severable and will not affect the validity and enforceability of the remaining positions.

12. Applicable law and jurisdiction

German law applies, excluding the UN Sales Convention (CISG). The legal domicile for the supplier and the buyer is Iserlohn, Germany.
